Cake Smash Photography Contract

 

This agreement is between the Client, whose name is                                                                , and Itsy Bitsy Images.

1. This photography package includes the session fee and 10 digital images.  

2.  Additional digital images above those included in the package may be purchased for $20 each or $100 for the full gallery.  A full gallery is the complete set of edited images presented in your online selection gallery.  A typical full gallery has between 15-25 images.  Unedited or raw pictures are not available.

3. The Client shall receive a print release for all digital images purchased.​

4.  Retainer and Payment Schedule.

   1.  The complete cost for this photography package is $585.

   2.  The Client shall make a non-refundable retainer of $100 to Itsy Bitsy Images to secure the booking.  Upon payment, a date as agreed upon at the bottom of this contract will be reserved for the Client.

   3. The remaining $485 will be due the day of the Client's photo session.

   4.   Payments may be made with cash or credit.

5.  Turnaround Times

   1.  An online selection gallery will be sent to the Client within 3 weeks of the session date.  Once the Client has chosen their pictures, they will receive a link to download their selections within 36 hours.

6.  Cooperation

   1.  Itsy Bitsy Images will do everything in its power to ensure that everyone at a photography session is comfortable and happy. 

   2.  However, no poses or compositions are guaranteed for any photo sessions.  Newborns and toddlers are sometimes temperamental and Itsy Bitsy Images cannot be responsible for non-cooperation by any of the subjects.

   3.  Reschedules for unsettled newborns or crying toddlers may be offered at Itsy Bitsy Images’ discretion on a case-by-case basis.

7.  Media Release

   1.  Itsy Bitsy Images may use the Client's pictures on it's website or social media.  

8.  Additional Editing

   1.  The Client’s selection gallery will be complete with fully edited photographs consistent with Itsy Bitsy Image’s portfolio.  Additional specific editing requests by Client will be accommodated at Itsy Bitsy Images’ discretion.  If extensive edits are requested, they will be billed at $50/hr.

   2.  No raw or unedited files are available to the Client.

9.  Limit of Liability

   1.  Itsy Bitsy Images takes the utmost care with the handling and storage of the digital images. However, in the unlikely event that the originals are lost, stolen, damaged or destroyed Itsy Bitsy Images’ liability is limited to the refund of all payments received, or a reshoot can be scheduled at no additional cost.  In the unlikely event that Itsy Bitsy Images is injured or becomes too ill to attend the scheduled portrait session, the session will be rescheduled to the earliest mutually acceptable date. In the unlikely event of a cancellation of this contract by either party, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.

10. Cancellations​

    1. In the event Itsy Bitsy Images is unable to complete the session on the scheduled date due to illness or emergency, Client will be allowed to choose either a refund of deposit, a rescheduled session, or a substitute photographer (JPShots) as available.​
